Family Preparedness

Every family, regardless of their immigration status, could benefit from having an emergency family preparedness plan. The packets linked in English, Español, Português, and Kreyòl ayisyen contain advice to help families prepare in case of an emergency, for example, in case a caregiver is detained and deported. This video also helps immigrant families prepare for emergencies and know their rights. The following organizations also help families with making a plan:

What to do if a loved one is detained by ICE?

  • You can review this resource from the MIRA Coalition to help prepare and be informed should you or a loved one is detained: https://miracoalition.org/immigration-detention-resources/
  • They may be eligible for bond, or release from immigration detention while their case is pending. The below organizations may be able to help:
    • BIJAN Bond Project: family or friends can call or text 617-396-7143 to see if their loved one is eligible. Detained individuals can call 617-637-8195 and leave a message.
    • Massachusetts Access to Counsel Initiative (MACI): 617-417-4325
    • PAIR Project: Family or friends can complete this intake about their detained relative. An individual detained by ICE may also call PAIR directly at (617) 362-3660 between 1:00 - 4:00 PM EST Monday and Thursday and 9:00 - 11:00 AM EST Tuesday and Friday. 
  • If your loved one already has an immigration attorney, the attorney or you can contact the Habeas Project (immigrationhabeasproject@gmail.com) to try to prevent their transfer to an out-of-state ICE detention center. 
     

Unlawful Practice of Immigration Law (also called Notario Fraud) 

Only certain individuals can legally give immigration advice and represent you in an immigration case. That includes:


Notaries public (notarios), interpreters, and travel agencies CANNOT provide legal advice. To verify if someone is authorized to practice immigration law:

  • For an attorney, you can look them up in the Massachusetts Board of Bar Overseers. Note that because immigration is federal, an attorney may have an office in Massachusetts but be barred in another state.


For an accredited representative, check the list on the DOJ Recognition and Accreditation Program website.
