District Immigration Guidance

Protecting All Students: Procedural Guidance for Responding to Federal Immigration Enforcement at Schools

In Boston Public Schools, we celebrate our rich diversity, which contributes to a vibrant community and experience for all our students. In the current climate, we must acknowledge the heightened concern in our schools, city, and neighboring communities regarding the presence of immigration enforcement officials. 

All of our students have the right to a free public education in the Boston Public Schools. Every day, families entrust us with the care of our more than 46,000 students and our focus must remain on educating our students inclusive of immigration status, their race or ethnicity, the language they speak, or the area of the city they live. 

BPS has thoroughly reviewed its policies and procedures and has issued specific guidance to staff to ensure that everyone understands their responsibilities to our students in accordance with district policy and all state and federal laws. The district has instituted a protocol that is designed to protect all BPS students by clarifying that only enrolled students and authorized adults are allowed into our buildings during the school day; extending supports to students affected by immigration enforcement actions outside of school; and specifying the procedures that must be followed in every instance whenever any law enforcement officer seeks access to or information about one of our students, whether at school, on a school bus, or while attending a school-sponsored event. The district has also set up a dedicated number where BPS staff can quickly connect with a BPS attorney at any time for confidential legal guidance on immigration matters.

BPS cannot and does not require or ask students or caregivers for information regarding their immigration status or citizenship during enrollment. Under the Family Educational Rights and Privacy Act (FERPA), records of student information are protected and the district cannot share personally identifiable information with law enforcement, including federal immigration enforcement agencies, without a court order or lawfully issued subpoena.

In February 2026, Mayor Wu issued an Executive Order to protect Bostonians from illegal federal overreach, prioritizing de-escalation, and reaffirming that Boston will hold anyone accountable who commits violence, property damage, or any criminal conduct in the City, including federal officials. This Executive Order includes all BPS schools and buildings.

BPS will always keep students’ needs, education and otherwise, at the forefront of our daily operations. We are committed to identifying staff training opportunities to continue learning and building our capacity to serve and protect students and their information, and continue to work with partners to provide resources to support the families we serve.
