FERPA and External Data Sharing

What is FERPA?

FERPA is a federal law that protects the privacy of student education records. It gives parents and eligible students the right to access and amend these records and restricts the disclosure of personally identifiable information without consent.

The FERPA statute is found at 20 U.S.C. § 1232g and the FERPA regulations are found at 34 CFR Part 99.

What does BPS consider "Directory Level information"?

Directory information includes the following: student’s name, age, grade level, dates of enrollment. BPS does not consider the date of birth, state unique student identification number, address, telephone listing, or school name as directory level information even though FERPA law includes this. Parents may opt-out of Directory Level information by contacting their child's school OR filling out the online contact form here: www.bostonpublicschools.org/contact
